Yaşamın Sonuna Dair Sorunlar ve Tıbbi Talimatname
Özet
Teknolojik gelişmelerle yoğun bakımlarda yaşam destek sistemlerinin artması, ölüm sürecinin yönetilmesinde hekimler için etik ve hukuki ikilemleri beraberinde getirmiştir. Yaşamın sonu dönemi, hastalığın ilerlediği ve tedavinin imkansız olduğu, sadece hastanın acısının dindirilerek konforunun amaçlandığı süreci ifade eder. Bu aşamada uygulanan kardiyopulmoner resüsitasyon (KPR) ve agresif yaşam destekleri gibi tedaviler, bazen hastanın yaşamını uzatmak yerine sadece acı dolu ölüm sürecini geciktirdiği için tıbbi açıdan "beyhude (yararsız) tedavi" olarak nitelendirilmekte ve etik ilkelerle çelişmektedir. Türk hukuku ve uluslararası sözleşmeler (Biyotıp Sözleşmesi gibi) kapsamında, bilinci açık hastaların tedaviyi reddetme ve kendi geleceğini belirleme hakkı üstün bir hak olarak kabul edilmektedir. Ancak bilinci kapalı hastalar ile terminal dönemdeki vakalarda net bir "Resüsite Etmeyiniz" (DNR) yasal düzenlemesinin bulunmaması hekimleri cezai sorumluluk korkusuyla endikasyonsuz tedavilere yöneltebilmektedir. Bu doğrultuda, bireylerin sağlığında tıbbi tercihlerini beyan edebileceği "Tıbbi Talimatname" (tıbbi vasiyet) uygulamasının Sağlık Bakanlığı veri sistemine entegre edilerek yasal altyapısının netleştirilmesi, tıp ve hukuk terminolojisinin ortaklaştırılması ve tıp müfredatına hukuk derslerinin eklenmesi gerekmektedir.
Technological advancements in intensive care and the prevalence of life-support systems have introduced ethical and legal dilemmas for physicians regarding the management of end-of-life processes. The end-of-life stage refers to a period where a disease has progressed irreversibly and treatment is no longer possible, focusing solely on alleviating the patient's suffering and ensuring comfort. At this stage, interventions such as cardiopulmonary resuscitation (CPR) and aggressive life support are often characterized as "futile treatment" because, rather than extending meaningful life, they merely prolong a painful dying process, which contradicts fundamental bioethical principles. Under Turkish law and international agreements like the Convention on Human Rights and Biomedicine, patients with decision-making capacity possess an absolute right to refuse treatment and exercise personal autonomy. However, the lack of explicit legal regulations regarding "Do Not Resuscitate" (DNR) orders for unconscious or terminal patients frequently drives physicians to perform medically non-indicated interventions out of fear of legal liability. Consequently, it is highly critical to implement a legally binding "Advance Directive" system integrated into the Ministry of Health's information infrastructure, standardize the terminology between medicine and law, and incorporate medical law courses into health science curricula.
